Acceptance of Event Admission Terms of Service
This World Dairy Expo, Inc. (“WDE”, “we”, or “us”) Event Admission Terms of Service (“Terms”) applies to the WDE hosted event at the Alliant Energy Center in Madison, Wisconsin USA from October 1, 2024 to October 4, 2024 (“Event”). By submitting your Event admission ticket order (“Order”), you acknowledge and accept these Terms, and any additional terms and conditions made available to you that are applicable to your attendance at the Event and any pre-Event or post-Event activities (“Rules”), which are incorporated herein by reference. WDE is using a third party payment processor, Webconnex Payments, to process payments and all payments are also subject to its terms and conditions (as applicable); provided that as between you and WDE, in the event of a conflict of such terms and conditions and these Terms, these Terms shall govern and control. Should you not wish to accept these Terms, you shall not order tickets to the Event through our website (“Site”). You acknowledge and agree that in the event you are placing an Order for a group of people (each of whom are additional ticket-holders), each such ticket-holder in such group is aware of these Terms and these Terms are binding on each such ticket-holder.

1. Admission Ticket Order Account and Event Attendance
1.1. Each ticket with valid QR code permits the attendee ticket-holder admittance into the Event for the Event date(s) specified on the ticket. Any and all other costs associated with your attendance at the Event (including without limitation, any travel and/or accommodation expenses and any expenses within the Event) shall be borne solely by you and WDE shall have no liability for such costs.
1.2. You may select the daily admission ticket (which grants admittance for a single day during the Event) or the season pass admission ticket (which grants admittance to all days of the Event). Each attendee 12 years old and older will require a ticket for each day of the Event. Each attendee must present his or her admission ticket daily for validation upon entry to the Event.
1.3. You acknowledge and understand we use your information to provide, analyze, administer, enhance and personalize our Site and the services we provide to you, including our marketing of our services to you as described in our Privacy Policy, found at https://worlddairyexpo.com/pages/Privacy-Policy.php (“Privacy Policy”). We also use your information to communicate with you and to operate our business, as further outlined in our Privacy Policy.
1.4. You will pay all charges incurred by you or any users of your account and credit card at the price(s) in effect when such charges are incurred, including any applicable taxes or fees. You may only use credit or debit cards that belong to you or to people who expressly authorize you to use such payment methods.
1.4.1. All service terms herein apply to any “Preferred Customer” or complimentary admission ticket offers (if applicable). Preferred Customer or complimentary ticket program coupons (“Coupon”) may be used once in a single use. You must enter the Coupon code to receive the admission ticket price discount. The amount discounted will be shown on the confirmation page.
1.4.1.1. Your contact data and information provided with the redemption of the Coupon will be shared with the providing authorized partner company.
1.4.2. International currency transactions will be processed in US Dollars at the current, applicable exchange rate at the time of sale (or processing of sale).
1.5. Your Order will be confirmed by email message to the account contact email address submitted with the Order. You are responsible for distributing the tickets purchased in the Order. Admission tickets may be distributed via Apple Wallet, Google Pay, text message, email, or print to other Event attendees.
1.6. As an Event attendee, you are encouraged to download our free mobile event app to plan your schedule, book trade show exhibitor meetings, receive Event notification updates and more.
1.7. Your ticket will provide you access to free Event site parking and the general admission events of the Event, but excludes any additional ticketed events, receptions, or dinners. All purchases made with any exhibitors or vendors, including, but not limited to, dairy cattle exhibitors and food and drink vendors, are at your sole discretion and cost. WDE shall have no liability for such arrangements or costs made by you with any exhibitors or vendors.
1.8. All admission ticket orders are final. No refunds will be granted. Events, programs, dates and times are subject to change without notice. WDE reserves the right to deny admission or eject any person violating WDE’s rules, local, state, or federal laws or whose conduct is deemed illegal, disorderly or offensive by management. Persons entering the Event may be subjected to search for illegal or unauthorized items and any such items are subject to confiscation.
1.9. WDE (and its designees and agents) may take photos, videos, interviews, and/or other recordings of the crowd and attendees at the Event. To the extent you are captured in any such recording, you (and each of your ticket-holders) grant irrevocable consent and permission to WDE (and its successors, assigns, licensees, designees, and agents) to utilize your name, image, likeness, actions, statements and/or voice in live or recorded audio, video or photographic display or other transmission, exhibition, publication or reproduction made of or at the Event in any medium or context, with or without edits or changes, any purpose whatsoever (including for commercial or promotional purposes), without further authorization or compensation. You (and each of your ticket-holders) agree that you have no (or otherwise waive any) claims or rights with respect to these recordings or any uses of them by WDE. You (and each of your ticket-holders) agree that you will not live broadcast or livestream any recordings of the Event, including without limitation, through YouTube, Facebook, X, Instagram, or any other communication channel or social media platform.
1.10. Due to the uncertainty related to severe acute respiratory syndrome coronavirus 2 (SARS-CoV-2), which is also known as COVID-19 (“COVID-19”), all tickets and your admission to the Event are subject to all safety and health requirements and policies put in place by WDE, and those policies and requirements of local health authorities (including, but not limited to, the Public Health Madison & Dane County and the Centers for Disease Control and Prevention). Such policies and requirements as they may be updated from time to time (in the sole determination of WDE) and as they may be communicated to you prior to or during the Event (whether orally or in writing) by, for example, instruction provided by WDE personnel or signage in or around Event, are collectively referred to as the “Safety Requirements”. You acknowledge and agree to comply with the Safety Requirements (including all requirements that must be satisfied prior to or during the Event), and attendance at the Event is conditioned on such compliance.

2. Notice regarding future changes to Terms
2.1. WDE may make changes to these Terms at any time. Any changes WDE makes will be effective immediately when a revised version of these Terms are posted on our Site. The “Last Updated” date above will tell you when these Terms were last revised. By continuing to use this Site or entering the Event after that date, you agree to the changes.

3. Solicitation Policy
3.1. Any persons observed soliciting business in any area other than in a purchased exhibit booth space will be immediately asked to leave the grounds. Additional penalties may be applied under Dane County Ordinances or Wisconsin State law. To protect our exhibitors, immediately report any violations or suspicious activity observed to the show office at 608-224-6455.

4. Protestor Policy
4.1. Protestors are not permitted on Event premises. However, protestors have a right to free speech. Law enforcement and Alliant Energy Center (Event grounds manager) officials have designated a place for protesters to stand on public ground at the north or south side of the Alliant Energy Center Rimrock Road entrance. Protestors do not have the right to disrupt the Event. Security and Law enforcement officials will remove protestors from the Event premises.

5. Unauthorized sale or use of Ticket
5.1. To ensure that your tickets are valid, purchase your tickets through our Site. Tickets purchased from unauthorized sales channels (e.g., scalpers) may be forged. Anyone caught forging entry tickets or any other special admission tickets in order to access or sell such tickets to the Event will be prosecuted. Counterfeit tickets will not be honored or refunded by WDE and your purchase of such ticket(s) is not binding on WDE.

6. Force Majeure
6.1. WDE shall not be liable for failure to perform any or all obligations due to events beyond its reasonable control, including, but not limited to, natural disasters; acts of war; threats or acts of terrorism; governmental actions; strikes or other labor disruptions; unavailability of transportation; unavailability of, or limitations on the use or capacity of, the event space due to safety concerns; or epidemics, pandemics, or other public health crises (including but not limited to COVID-19) and/or the public health response to the same whether by formal orders or governmental recommendations. WDE shall not be liable for any claims for loss or damage due to the failure to hold the Event.

7. Disclaimer of Warranties
7.1 WE PROVIDE THIS SITE TO YOU “AS IS” AND “AS AVAILABLE”. WE TRY TO KEEP THE SITE UP, BUG-FREE AND SAFE, BUT YOU USE IT AT YOUR OWN RISK. TO THE FULLEST EXTENT PERMISSIBLE BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF TITLE, NON-INFRINGEMENT, ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR WARRANTIES THAT MAY ARISE FROM COURSE OF DEALING OR COURSE OF PERFORMANCE OR USAGE OF TRADE. WE DO NOT GUARANTEE THAT THE SITE WILL ALWAYS BE SAFE, SECURE OR ERROR-FREE OR THAT THE SITE WILL ALWAYS FUNCTION WITHOUT DISRUPTIONS, DELAYS OR IMPERFECTIONS. WE ARE NOT RESPONSIBLE FOR THE ACTIONS OR INFORMATION OF THIRD PARTIES, AND YOU RELEASE US FROM ANY CLAIMS AND DAMAGES, KNOWN AND UNKNOWN, ARISING OUT OF OR IN ANY WAY CONNECTED WITH ANY CLAIM YOU HAVE AGAINST ANY SUCH THIRD PARTIES.

8. Limitation of Liability
8.1. You and your ticket-holders voluntarily assume all risk and danger of personal injury (including death), any risk of contracting a communicable disease or illness (including exposure to COVID-19, as well as any mutation, adaptation or variation thereof), a bacteria, virus, or other pathogen capable of causing a communicable disease or illness), and all hazards arising from, or related in any way to, the Event (including, but not limited to, injuries caused by attendees, cattle, or other objects) whether occurring prior to, during or after the Event.
8.2. IN NO EVENT WILL WDE, ITS AFFILIATES OR SUBSIDIARIES, OR ITS AND THEIR DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, VOLUNTEERS, LICENSORS, EXHIBITORS, SPONSORS, SERVICE PROVIDERS, SUCCESSORS, AND ASSIGNS (COLLECTIVELY, THE “WDE PARTIES”) BE LIABLE TO YOU OR ANYONE ELSE FOR, AND YOU HEREBY KNOWINGLY AND EXPRESSLY WAIVE ALL RIGHTS TO SEEK, ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES OF ANY TYPE, AND ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED, UNDER THESE TERMS OR ARISING OUT OF OR IN CONNECTION WITH THE EVENT, WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHER LEGAL OR EQUITABLE THEORY, EVEN IF FORESEEABLE OR IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
8.3. IN NO EVENT WILL THE AGGREGATE LIABILITY OF THE WDE PARTIES UNDER THESE TERMS OR ARISING OUT OF OR IN CONNECTION WITH THE EVENT (REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT, OR OTHERWISE) EXCEED THE AMOUNT YOU HAVE PAID US FOR YOUR ORDER OF TICKETS TO THE EVENT. IN NO EVENT WILL YOUR ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF DAMAGES, SO THE EXCLUSIONS IN SECTION 8 MAY NOT APPLY TO YOU. IN SUCH CASES, THE WDE PARTIES’ LIABILITY WILL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

9. Hold Harmless
9.1. You and each of your ticket-holders agree to defend, indemnify, and hold the WDE Parties harmless from and against any claims, actions, losses, liabilities, judgements, damages, costs, expenses, or fees (including attorneys’ fees) arising out of, or relating to (A) your violation of these Terms, and (B) your actions and omissions at, around, or while traveling to and from, the Event.

10. Governing Law
10.1. All matters relating to this Agreement, and any dispute or claim arising therefore or related thereto, shall be interpreted according to the laws of the state of Wisconsin without regard to or application of choice-of-law rules or principles.

11. Arbitration and Class Action Waiver
11.1. PLEASE READ THIS SECTION 11 CAREFULLY. BY AGREEING TO THESE TERMS, YOU AGREE THAT YOU ARE REQUIRED TO RESOLVE ANY CLAIM THAT YOU MAY HAVE AGAINST WDE ON AN INDIVIDUAL BASIS IN ARBITRATION, SUBJECT TO THE TERMS AND CONDITIONS SET FORTH IN THIS SECTION 11, WHICH IS REFERRED TO AS THE “ARBITRATION AGREEMENT.” THIS ARBITRATION AGREEMENT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT. IT ALSO CONTAINS PROCEDURES FOR MANDATORY BINDING ARBITRATION AND A CLASS ACTION WAIVER.
11.2. You agree that any and all claims and disputes arising from or relating in any way to the subject matter of these Terms or arising out of or relating to the Event shall be finally settled and resolved through binding individual arbitration as described in this Section 11. The arbitration will be administered by JAMS under its Streamlined Arbitration Rules and Procedures or, if applicable, its Comprehensive Arbitration Rules and Procedures, and any applicable supplemental rules including its Consumer Arbitration Standards of Minimum Fairness (“JAMS”). All arbitration proceedings shall be before a single arbitrator, held in English, and in accordance with governing law set forth in Section 10 above. The arbitrator’s ruling is final and binding, and may be entered as a judgment in any court of competent jurisdiction.
11.3. The JAMS Rules are available online at https://www.jamsadr.com or by calling (800) 352-5267. There is no judge or jury in arbitration. YOU UNDERSTAND AND AGREE THAT BY AGREEING TO RESOLVE ANY DISPUTE THROUGH INDIVIDUAL ARBITRATION, YOU ARE WAIVING THE RIGHT TO A COURT OR JURY TRIAL. ANY DISPUTE SHALL BE ARBITRATED ON AN INDIVIDUAL BASIS, AND NOT AS A CLASS ACTION, REPRESENTATIVE ACTION, CLASS ARBITRATION, OR SIMILAR PROCEEDING. YOU AGREE THAT ALL CHALLENGES TO THE VALIDITY AND APPLICABILITY OF THIS AGREEMENT TO ARBITRATE (I.E., WHETHER A PARTICULAR CLAIM OR DISPUTE IS SUBJECT TO ARBITRATION) SHALL BE DETERMINED BY THE ARBITRATOR. NOTWITHSTANDING ANY PROVISION IN THESE TERMS TO THE CONTRARY, IF THE CLASS ACTION WAIVER ABOVE IS DEEMED INVALID OR UNENFORCEABLE, YOU AGREE THAT YOU SHALL NOT SEEK TO, AND WAIVE ANY RIGHT TO, ARBITRATE CLASS OR COLLECTIVE CLAIMS.
11.4. If you wish to opt out of this Arbitration Agreement, within 45 days of the effective date of these Terms or when you first purchase tickets on the Site, whichever is later, you must send us a letter stating: “Request to Opt-out of Agreement to Arbitrate” to:

11.5. If the Arbitration Agreement is found unenforceable or to not apply for a given dispute, or if you opt out of the Arbitration Agreement in accordance with Section 11.4, then, unless prohibited by applicable law, the proceedings must be brought exclusively in the state or federal courts in Dane County, State of Wisconsin. You agree to submit to the personal jurisdiction of each of these courts for the purposes of litigating such claims or disputes. YOU HEREBY WAIVE YOUR RIGHT TO A JURY TRIAL, WAIVE YOUR RIGHT TO INITIATE OR PARTICIPATE IN A CLASS OR COLLECTIVE ACTION, AND AGREE TO REMAIN BOUND BY ANY AND ALL LIMITATIONS OF LIABILITY AND DAMAGES INCLUDED IN THESE TERMS.

12. Miscellaneous
12.1. Medical Care. You hereby consent to medical care and transportation in order to obtain treatment in the event of injury as WDE staff, security, police or medical professionals may deem appropriate in their reasonable discretion. You understand this waiver extends to any liability that arises out of, or is in any way connected with, the medical treatment and transportation provided in the event of an emergency and/or injury. YOU HEREBY AGREE TO RELEASE AND HOLD HARMLESS THE WDE PARTIES FROM ANY LIABILITY ARISING OUT OF OR IN CONNECTION WITH THE ACTIONS OR OMISSIONS OF THE WDE PARTIES RELATED TO YOUR MEDICAL CARE.
12.2. Severability. In the event any term or provision in these Terms are held by an arbitrator, court, or other tribunal of competent jurisdiction to be invalid or unenforceable, then such invalidity or unenforceability shall have no effect on the other terms and provisions of these Terms, which shall remain valid, binding and enforceable and in full force and effect, and such invalid or unenforceable term or provision will be enforced to the maximum extent permissible under applicable law.
12.3. Waiver. No failure of by you or WDE to exercise or enforce any of its rights under these Terms shall act as a waiver of subsequent breaches and the waiver of any breach shall not act as a waiver of subsequent breaches.
12.4. Survival. The provisions set forth in Sections 1.9, 2, 6, 7, 8, 9, 10, 11, 12 and any other right or obligation of you or WDE that, by its nature, should survive the completion of the Event, will survive the completion of the Event.
